Death Valley: Terms and Conditions

I. IN CONSIDERATION OF the covenants and agreements contained in this Agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties to this terms & conditions agree as follows:

Boston Photography Workshops will provide educational enrichment for trips as outlined on its website (bostonphotographyworkshops.com)  and may license qualified professional Instructors to organize and administer such Tours. Any such designated instructor, its parent, subsidiaries, and assigns, and their respective employees, affiliates, officers, directors, successors, representatives, agents and assigns (collectively “Instructors”), in turn, acts only as an agent for any transportation carrier, hotel, ground operator, or other suppliers of services connected with specific Tour (“Third Parties”), and the Third Parties are solely responsible and liable for providing their respective services. The passenger tickets in use by the carriers will constitute the sole contract between the carriers and the passenger; the carriers are not responsible for any act, omission, or event during the time the participants are not aboard their conveyances.

Boston Photography Workshops, and their respective employees, affiliates, officers, directors, successors, representatives, agents and assigns (collectively “Boston Photography Workshops”) and the Instructors will not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any Third Parties including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such Third Parties; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. The participant waives any claim against Boston Photography Workshops and/or the Instructors for any such loss, damage, injury, or death.

By registering for a Tour, the participant certifies that they do not have any mental, physical, or other condition or disability that would create a hazard for himself or herself or other participants. Boston Photography Workshops and the Instructors reserve the right in their sole discretion to accept, decline to accept, or remove any participant on a Tour. Boston Photography Workshops and the Instructor reserve the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of the participants.

Neither Boston Photography Workshops, nor the Instructors, will be liable for any air carrier's cancellation penalty incurred by the purchase of a nonrefundable ticket to or from the participant's Tour departure city. Baggage and personal effects are at all times the sole responsibility of the participant.

II. Eligibility: Anyone under 18 must be accompanied by a parent or guardian for the entire Expedition.

III. Student Cancellation Policy: We understand that attending our workshops requires advance commitment, and also that things can happen in life that may require you to cancel from a workshop.

A $400.00 non-refundable deposit per participant is required at the time of registration to reserve your spot. Payment in Full is required when registration is completed 60 days before the departure date. If a participant would like to cancel, they must send an email notification. Please note your cancellation is not considered official until you have received a return email confirmation acknowledging your cancellation. At the time, we receive your cancellation email, the following per person charges will be applied: 

  • + 61 days before the start date: a full refund of any paid registration fee and 50% of the initial deposit.

  • Between 60-31 days of the start date: 50% of any paid registration fee and 50% of the inital deposit.

  • 30 days or fewer to the start date: no refunds can be issued. Your registration and deposit can be used towards other workshops within 4 years time. 

Payments in Full are required no later than 60 days prior to departure. If full and final payment is not received by this time, you will be notified via email two times requesting final payment. After that, we will consider your failure to make a payment a cancellation and your spot in the Trip will be forfeit and offered to those participants on the waiting list. 

In extreme situations, cancellations can be considered on a case-by-case basis. Refunds will be issued as credit for a future travel trip used within 2 years.

This policy also applied to pre- and post-photography tour extensions and extra arrangements confirmed on any participant’s behalf. Any revisions made within the Cancellation Period such as a change in departure date or choice of the Death Valley Photography tour, are subject to this cancellation policy. Arriving late or leaving the Tour early, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of the Tour. 

VI. Trip Cancellation Policy: Boston Photography Workshops reserves the right to cancel any photo workshop because of inadequate enrollment that makes the Tour economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If the Tour is cancelled prior to departure, the Boston Photography Workshops will provide the participants 100% of their registration fee minus the $400.00 non-refundable deposit associated with vendor fees. In the scenario that the cancellation is due to a significant event that makes it infeasible to operate the Tour as planned, but able to reschedule for the future, the Boston Photography Workshops will provide the participants with a refund and/or credit towards a workshop equivalent to the amount paid to the company.

If the Boston Photography Workshops cancels the Tour in progress, the participants will receive a prorated refund based on the number of days not completed on the Tour. If a participant elects to leave the Tour in progress in their own volition, the participant will not receive any type of refund. 

If the Boston Photography Workshops cancels the Tour in progress, or if the participant elects to leave the Tour in profess in their own volition, the participant acknowledges and agrees that (i) the participant shall be solely responsible for their travel plans once they depart the Tour, (ii) neither Boston Photography Workshops or the Instructors shall have any responsibility or control over the participant’s safety or activity once they depart the Tour, and (iii) the participant releases and holds harmless Boston Photography Workshops and the Instructors, from any and all costs, liability, loss, damage, injury, or death that may arise out of the participant’s decision to not return to their original point of departure from the cancelled Tour in progress. 

Except as outlined above when Boston Photography Workshops cancels a Tour, Boston Photography Workshops and the Instructors have no responsibility for any expenses, including any non-refundable expenses, incurred by the participants in preparing for a cancelled Tour or for any additional arrangements should the participants embark prior to the scheduled group departure date. 

V. Itinerary Changes: The itinerary may be subject to change and replaced with similar experiences. Nevada is known for its dry climate and moderate winter temperatures. In the event of heavy rain or other natural events, some of our photographic instruction will be indoors or in covered areas. Every reasonable effort will be made to operate the Tour as planned, but alterations may still occur after final itineraries are sent. No refunds will be given in the event of an itinerary change. 

VI. Optional Excursions: If a participant elects to participate in any additional activity or excursion that is not arranged or led by the Boston Photography Workshops or the Instructor, neither the Boston Photography Workshops or Instructors shall have any responsibility for or control over the participant’s safety or well-being, and the participant releases and holds harmless Boston Photography Workshops and the Instructors from any and all costs, liability, loss, damage, injury, or death arising from the participant’s decision to participate in such activity or excursion. 

VII. Third Party Services: The Boston Photography Workshops may utilize third party tour organizers, transportation providers, hotel operators, and food providers to provide the services associated with the Tour. All tickets, coupons, reservations, etc. are subject to the terms and conditions and other policies of the third-party service provider. The Boston Photography Workshops can not control the actions of such third-parties and do not assume responsibility for any unanticipated events that may occur, including, without limitation, travel delays, lost luggage, cancellations, overbooking, and other reservation errors. Participants will not be entitled to a refund in the event of unanticipated events requiring scheduling changes. You further agree to hold us harmless from and against any liability for injury, damage, loss, accident, delay, irregularity, or death that might occur in connection with any services provided by third parties. 

VIII. Travel Documentation: Participants are responsible for obtaining any documents required for their participation in the Tour such as a valid passport, applicable visas, applicable vaccination certificates, and any other documents. Failure to obtain documents does not negate the terms and conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the participant’s responsibility. 

IX. Trip Cancellation, Travel, and Medical Health Insurance: Trip cancellation and medical health insurance are strongly recommended. Each participant will be responsible for their trip cancellation and travel medical health insurance for the Death Valley Photography Workshop. Participants will need valid travel documents, as mentioned in the section titled: “Travel Documentation.” Participants will be asked to sign a release form and liability waiver. 

X. Health Requirements: The Boston Photography Workshops reasonably accommodates travelers with disabilities on all of its trips, but some trips may not be suitable for some travelers. Any physical condition, diet, or treatment requiring special attention must be reported in writing when the reservation is made.Our scheduled Death Valley Photography Workshop requires light to moderate activity. You will be walking at least 1-2 miles on uneven surfaces, up stairs and small hills, as well as getting in and out of vehicles. There will also be some elevation changes throughout some routes. You will need to be able to carry your own gear (estimated: 15 pounds). If the participant requires a slower pace, extra assistance, or the use of a cane or walking stick, arrangements can be made by the Boston Photography Workshops. If the participant would like to forgo some of the scheduled sightseeing to rejuvenate and relax, they may feel free to do so at any time. 

Some areas and/or facilities may be outdated, which means they may not comply with current accessibility codes. By participating in this Tour, you further agree to the BPW is not responsible or liable for any difficulty, harm, or hindrance,  in route and access in connection with any services provided by third parties. 

The Boston Photography Workshops encourages participants to consult a doctor for specific medical advice about any activities or destinations. Please note that any health or mobility concerns you mention to the Boston Photography Workshops will be handled with the utmost confidentiality and will not impact the quality of your experience during the Tour. 

XI. Medical Authorization and Coverage: In the event the participant becomes sufficiently incapacitated as to be unable to direct their own care, their is no one on the Tour who can direct participant’s care, and Boston Photography Workshops is unable or does not have time to contact participant’s emergency contact, the participant, by registering and paying a deposit for the Tour, authorizes any medical treatment deemed necessary by a licensed physician in the event of any injury or illness. 

XII. Model Release and Photography: The Boston Photography Workshops and the Instructors reserve the right to take photographs or videos during the operation of the Tour or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a reservation on any Tour, Workshop, or participating event with the BPW, the participant agrees to allow their likeness to be used by Boston Photography Workshops and the Instructors without compensation to the participant. If the participant prefers that their likeness not be used, they must notify the Boston Photography Workshops and the Instructors in writing prior to departure of the Tour.

Copyright in all photographs, video, and related materials created by the participant (“Tour Materials”) will belong to the participant upon creation. The participant grants to Boston Photography Workshops a non-exclusive, international, irrevocable license to use any Tour Materials provided to Boston Photography Workshops in any media for the following purposes: editorial use, promotion, promotion of Boston Photography Workshops travel tours, or promotion of the mission of Boston Photography Workshops. 

XIII. Assumption of Risk: By registering for the Tour, the participant acknowledges that he/she is aware that travel such as the Tour they are undertaking involves potentially dangerous activities, some in remote areas of the United States, with a risk of illness, injury or death which may be caused by forces of nature, illness, or by willful or criminal conduct of third parties.. The participant further acknowledges that weather conditions may be severe, adverse and/or unpleasant and that medical services or facilities may not be readily available or accessible or consistent during some or all of the time during which he/she is participating on the Tour.

XIV. Changes to this Statement: Boston Photography Workshops reserves the right to change these Terms and Conditions. We will notify participants about any significant changes by sending a notice to the primary email address specified in your account. Your continued Participation after any potential modifications will constitute your: (i) acknowledgement of the modified Terms and Conditions; and (ii) agreement to abide and be bound by that policy.

XV. Concurrent Release: The Participant acknowledges that the terms & conditions given with the express intention of effecting the extinguishment of certain obligations owed to the Participant and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives and assigns.
